Dar e important de re\u021binut chiar de la bun \u00eenceput c\u0103 <strong>decizia nu este definitiv\u0103 \u0219i poate fi atacat\u0103 cu recurs<\/strong>, deci nu vorbim \u00eenc\u0103 despre o \u00eengropare final\u0103 a sistemului.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">De ce a ajuns subiectul \u00een instan\u021b\u0103? Pentru c\u0103 toate problemele semnalate de angajatori, de c\u00e2nd a fost introdus REGES \u0219i p\u00e2n\u0103 acum, au fost, \u00een sf\u00e2r\u0219it, confirmate. Pe scurt, mai mul\u021bi speciali\u0219ti \u00een legisla\u021bia muncii \u0219i companii, prin Uniunea Na\u021bional\u0103 a Exper\u021bilor \u00een Legisla\u021bia Muncii, au contestat hot\u0103r\u00e2rea pentru c\u0103 ar fi introdus norme neclare, obliga\u021bii administrative suplimentare pentru angajatori, dificult\u0103\u021bi tehnice \u0219i procedurale, f\u0103r\u0103 o analiz\u0103 real\u0103 de impact asupra IMM-urilor \u0219i f\u0103r\u0103 o consultare suficient\u0103 cu profesioni\u0219tii care folosesc zilnic sistemul.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">Altfel spus, <strong>problema nu e ideea de digitalizare<\/strong> \u00een sine, ci <strong>felul \u00een care a fost implementat\u0103<\/strong>: prea mult\u0103 presiune pe angajatori, prea multe zone neclare \u0219i prea pu\u021bin\u0103 predictibilitate.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\"><strong>\ud83d\udccc&nbsp;Ce se schimb\u0103 concret, acum?<\/strong> Nimic. Instan\u021ba a admis anularea, dar a respins cererea de suspendare a actului. Adic\u0103 reglementarea r\u0103m\u00e2ne \u00een vigoare p\u00e2n\u0103 la decizia final\u0103. Pe rom\u00e2ne\u0219te: <strong>obliga\u021biile tale ca angajator sunt exact acelea\u0219i ca s\u0103pt\u0103m\u00e2na trecut\u0103<\/strong>.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">Dar ce s-ar schimba dac\u0103 anularea ar r\u0103m\u00e2ne definitiv\u0103? Pe scurt, nu foarte multe. A\u0219a cum explic\u0103 <a href=\"https:\/\/www.avocatnet.ro\/articol_71987\/Cinci-aspecte-privind-anularea-HG-nr-295-2025-in-instan%C8%9B%C4%83-O-victorie-definitiv%C4%83-pentru-angajatori-sau-o-simpl%C4%83-revenire-la-vechile-obliga%C8%9Bii.html\" target=\"_blank\" rel=\"noopener noreferrer\" style=\"color: #1038e0; font-weight: 400; text-decoration: underline;\">Avocatnet<\/a>, cel mai probabil ne-am \u00eentoarce la o variant\u0103 mai veche, aproape identic\u0103 cu ce exist\u0103 acum. Firmele ar sc\u0103pa doar de c\u00e2teva raport\u0103ri ad\u0103ugate recent, cum ar fi suspendarea pentru concedii medicale \u0219i datele despre gradul de handicap al angaja\u021bilor.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">P\u00e2n\u0103 una-alta, business as usual. Te \u021binem la curent cu ce decide \u00cenalta Curte la recurs \u0219i ce \u00eenseamn\u0103 asta, concret, pentru tine.<\/p>\n\n        <div style=\"margin: 10px 0px;\">\n          <hr style=\"border-width: 0; border-top: 1px solid #1038e0; margin: 0;\" align=\"center\">\n        <\/div>\n\n        <!-- \u2500\u2500 TVA \u2500\u2500 -->\n        <p style=\"text-align: left; margin: 16px 0;\"><strong>Firmele care dep\u0103\u0219esc plafonul de TVA ar putea primi 3 zile lucr\u0103toare pentru \u00eenregistrare \u23f1\ufe0f<\/strong><\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">Senatul a adoptat un proiect care ar da firmelor un termen de <strong>3 zile lucr\u0103toare<\/strong> pentru solicitarea codului de TVA dup\u0103 dep\u0103\u0219irea plafonului de scutire. \u00cen prezent, plafonul de scutire este de <strong>395.000 lei<\/strong>, iar \u00eenregistrarea trebuie cerut\u0103 cel t\u00e2rziu la data dep\u0103\u0219irii plafonului.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">De multe ori, asta e o regul\u0103 destul de greu de respectat \u00een practic\u0103, mai ales dac\u0103 dep\u0103\u0219irea se \u00eent\u00e2mpl\u0103 \u00een weekend, \u00eentr-o zi super aglomerat\u0103 sau fix atunci c\u00e2nd ai nevoie s\u0103 actualizezi rapid proceduri, case de marcat \u0219i facturare.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">Dac\u0103 proiectul ajunge s\u0103 fie adoptat \u00een forma actual\u0103, regimul normal de TVA ar urma s\u0103 se aplice din ziua urm\u0103toare comunic\u0103rii codului de TVA, nu instantaneu din momentul dep\u0103\u0219irii plafonului. \u0218i, chiar dac\u0103 pare o schimbare mic\u0103, la firul ierbii o s\u0103 conteze destul de mult, tocmai pentru c\u0103 o s\u0103 \u00ee\u021bi ofere un r\u0103gaz mai clar \u0219i mai rezonabil pentru conformare. Ei bine, dup\u0103 c\u00e2teva s\u0103pt\u0103m\u00e2ni de confuzie pentru creatori, jurnali\u0219ti, traduc\u0103tori, arti\u0219ti, influenceri, persoane pl\u0103tite pe drepturi de autor \u0219i alte persoane fizice care se identific\u0103 fiscal prin CNP, <strong>schimbarea a devenit oficial\u0103<\/strong>: <strong>Legea nr. 88\/2026<\/strong> a fost publicat\u0103 \u00een Monitorul Oficial \u0219i <strong>elimin\u0103 obligativitatea utiliz\u0103rii RO e-Factura<\/strong>.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">Dac\u0103 vrei, po\u021bi s\u0103 folose\u0219ti \u00een continuare sistemul, dar e op\u021bional. Iar \u00een Rom\u00e2nia, asta se traduce prin <strong>salarii stabilite mai clar<\/strong>, <strong>comunicare transparent\u0103<\/strong> \u00een recrutare \u0219i <strong>eliminarea diferen\u021belor nejustificate<\/strong>.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">Dar <strong>NU<\/strong> \u00eenseamn\u0103 c\u0103 salariile tuturor angaja\u021bilor vor ap\u0103rea \u00eentr-un tabel public, cu nume, prenume \u0219i cafeaua preferat\u0103.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\"><strong>Ce se schimb\u0103 \u00een recrutare?<\/strong><\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">Angajatorii vor trebui s\u0103 le ofere candida\u021bilor <strong>informa\u021bii despre salariul de \u00eenceput<\/strong> sau <strong>intervalul salarial<\/strong> pentru pozi\u021bia la care aplic\u0103, fie direct \u00een anun\u021b, fie prin comunicare direct\u0103 \u00eenainte de interviu. \u00cen plus, angajatorii nu vor mai putea \u00eentreba candida\u021bii ce salariu au avut la joburile anterioare. Altfel spus, dispare clasicul <em>Dar acum c\u00e2t c\u00e2\u0219tigi?<\/em>.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">Dac\u0103 e\u0219ti antreprenor, noile reguli te oblig\u0103 s\u0103 reg\u00e2nde\u0219ti anun\u021burile de angajare &#8211; nu mai e suficient \u201esalariu motivant&#8221; sau \u201epachet atractiv&#8221;. \u00cen mod ideal, fiecare rol ar trebui s\u0103 aib\u0103 un interval salarial realist, stabilit pe criterii clare: responsabilit\u0103\u021bi, senioritate, experien\u021b\u0103, complexitatea muncii \u0219i nivelul de autonomie.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\"><strong>Ce drepturi vor avea angaja\u021bii?<\/strong><\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">Angaja\u021bii vor putea cere informa\u021bii despre propriul nivel de remunerare \u0219i despre nivelurile medii de remunerare pentru colegii care fac aceea\u0219i munc\u0103 sau munc\u0103 de valoare egal\u0103. <strong>Dar aten\u021bie aici<\/strong>: angajatul nu prime\u0219te automat salariul nominal al colegului de birou, ci informa\u021bii agregate\/statistice, utile pentru a verifica dac\u0103 exist\u0103 diferen\u021be salariale nejustificate.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">Angajatorii vor trebui s\u0103 poat\u0103 explica \u0219i criteriile folosite pentru stabilirea salariului \u0219i evolu\u021bia salarial\u0103. Asta \u00eenseamn\u0103 c\u0103 deciziile de tip <em>a\u0219a am sim\u021bit noi<\/em> sau <em>el a negociat mai bine<\/em> vor deveni tot mai greu de explicat.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\"><strong>Ce obliga\u021bii interne apar pentru firme?<\/strong><\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">Dac\u0103 e\u0219ti antreprenor \u0219i ai angaja\u021bi, va trebui s\u0103 \u00eencepi s\u0103 faci ordine \u00een zona de salarii. Pe scurt, asta \u00eenseamn\u0103 s\u0103:<\/p>\n\n        <ul style=\"text-align: left;\">\n          <li>define\u0219ti intervale salariale pentru roluri;<\/li>\n          <li>stabile\u0219ti criterii clare de diferen\u021biere \u00eentre junior, mid \u0219i senior;<\/li>\n          <li>documentezi criteriile de cre\u0219tere salarial\u0103;<\/li>\n          <li>verifici dac\u0103 exist\u0103 diferen\u021be mari \u00eentre persoane care fac munc\u0103 similar\u0103;<\/li>\n          <li>te asiguri c\u0103 anun\u021burile de job \u0219i procesele de recrutare sunt neutre \u0219i corecte;<\/li>\n          <li>elimini clauzele sau practicile care \u00eei \u00eempiedic\u0103 pe angaja\u021bi s\u0103 discute despre propriul salariu, acolo unde exist\u0103.<\/li>\n        <\/ul>\n\n        <p style=\"text-align: left; margin: 16px 0;\"><strong>\ud83d\udccc De re\u021binut<\/strong>: transparen\u021ba salarial\u0103 nu te oblig\u0103 s\u0103 pl\u0103te\u0219ti pe toat\u0103 lumea la fel. Po\u021bi avea salarii diferite, dar diferen\u021bele trebuie s\u0103 poat\u0103 fi explicate prin criterii obiective: experien\u021b\u0103, performan\u021b\u0103, responsabilitate, rezultate, competen\u021be, rol, nivel de senioritate.<\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\"><strong>Cine are obliga\u021bii de raportare?<\/strong><\/p>\n\n        <p style=\"text-align: left; margin: 16px 0;\">Pe l\u00e2ng\u0103 regulile \u0219i obliga\u021biile generale, directiva UE introduce \u0219i <strong>raport\u0103ri privind diferen\u021bele de remunerare \u00eentre femei \u0219i b\u0103rba\u021bi<\/strong>.
