La fel \u0219i dac\u0103 ai un SRL \u0219i un PFA care colaboreaz\u0103 \u00eentre ele.<\/p>\n<p style=\"text-align: left; margin: 16px 0;\"><strong>Ce \u00eenseamn\u0103 asta concret?<\/strong><strong><\/strong><\/p>\n<p style=\"text-align: left; margin: 16px 0;\"><strong><\/strong>C\u0103 orice tranzac\u021bie \u00eentre firmele respective \u2013 fie c\u0103 vorbim de o factur\u0103, un \u00eemprumut, o v\u00e2nzare de bunuri sau prest\u0103ri servicii \u2013 trebuie s\u0103 se fac\u0103 <strong>la pre\u021bul corect de pia\u021b\u0103<\/strong>, nu la o sum\u0103 \u201earbitrar\u0103&#8221; decis\u0103 \u00eentre p\u0103r\u021bi.<\/p>\n<p style=\"text-align: left; margin: 16px 0;\"><strong>De ce exist\u0103 aceast\u0103 regul\u0103?<\/strong><strong><\/strong><\/p>\n<p style=\"text-align: left; margin: 16px 0;\"><strong><\/strong>Pentru c\u0103, \u00een rela\u021biile \u00eentre firme afiliate, <strong>exist\u0103 riscul de a manipula artificial profitul \u0219i taxele<\/strong> (de exemplu, s\u0103 mu\u021bi profitul dintr-o firm\u0103 \u00een alta ca s\u0103 pl\u0103te\u0219ti mai pu\u021bin impozit). De aceea, Codul Fiscal impune principiul <strong>\u201evalorii de pia\u021b\u0103&#8221;<\/strong>: pre\u021bul dintre firme afiliate trebuie s\u0103 fie acela\u0219i pe care l-ar fi acceptat dou\u0103 firme independente, \u00een condi\u021bii normale de pia\u021b\u0103.<\/p>\n<p style=\"text-align: left; margin: 16px 0;\"><strong>\ud83e\uddfe Ce trebuie s\u0103 \u0219tii dac\u0103 facturezi \u00eentre firme afiliate<\/strong><\/p>\n<ul style=\"text-align: left;\">\n<li>Po\u021bi factura \u00eentre firme, <strong>dar doar la pre\u021buri reale, de pia\u021b\u0103<\/strong> \u2013 adic\u0103 nu po\u021bi vinde o ma\u0219in\u0103 \u00eentre firmele tale cu 1 leu sau s\u0103 emi\u021bi o factur\u0103 de servicii fictive.<\/li>\n<li>Dac\u0103 valoarea tranzac\u021biilor e mare, <strong>ANAF poate cere dosarul pre\u021burilor de transfer<\/strong>, adic\u0103 documenta\u021bia care demonstreaz\u0103 cum ai stabilit pre\u021bul.<\/li>\n<li>Pentru firmele din categoria contribuabili mari, dosarul devine obligatoriu dac\u0103 se dep\u0103\u0219esc anumite praguri anuale (350.000 \u20ac pentru bunuri, 250.000 \u20ac pentru servicii, 200.000 \u20ac pentru dob\u00e2nzi).<\/li>\n<li>Pentru firmele mici \u0219i mijlocii, pragurile scad (100.000 \u20ac pentru bunuri, 50.000 \u20ac pentru servicii sau dob\u00e2nzi).<\/li>\n<li>Chiar \u0219i sub aceste praguri, la un control fiscal <strong>trebuie s\u0103 po\u021bi justifica pre\u021burile<\/strong> \u2013 cu oferte similare din pia\u021b\u0103, rapoarte de evaluare, anun\u021buri de v\u00e2nzare, sau alte dovezi obiective.<\/li>\n<\/ul>\n<p style=\"text-align: left; margin: 16px 0;\"><strong>\ud83d\udca1<\/strong><strong> Cazuri frecvente<\/strong><\/p>\n<ul style=\"text-align: left;\">\n<li><strong>V\u00e2nzarea unei ma\u0219ini sau a unui imobil<\/strong> \u00eentre dou\u0103 firme unde e\u0219ti asociat: tranzac\u021bia trebuie s\u0103 respecte valoarea real\u0103 din pia\u021b\u0103.<\/li>\n<li><strong>Facturarea de servicii<\/strong> \u00eentre firmele tale: ANAF poate verifica dac\u0103 serviciile au fost reale \u0219i la pre\u021b corect.<\/li>\n<li><strong>\u00cemprumuturi sau transferuri de bani<\/strong> \u00eentre firme afiliate: pot fi re\u00eencadrate ca alte venituri dac\u0103 nu sunt justificate corect.<\/li>\n<\/ul>\n<p style=\"text-align: left; margin: 16px 0;\">\ud83d\udccc <strong>Concluzie: <\/strong>&nbsp;Dac\u0103 ai mai multe firme, trateaz\u0103-le ca entit\u0103\u021bi independente. Focusul lor nu mai este pe a excela, ci pe a bifa ce trebuie pentru a ob\u021bine recompensa sau a evita pedeapsa. Dac\u0103 totul se reduce la bani, <strong>dispare satisfac\u021bia intrinsec\u0103<\/strong>.<\/li>\n<\/ul>\n<ul style=\"text-align: left;\">\n<li><strong>Iner\u021bia <\/strong>\u2013 apare c\u00e2nd oamenii ajung s\u0103 lucreze din obi\u0219nuin\u021b\u0103, f\u0103r\u0103 niciun fel de entuziasm sau direc\u021bie clar\u0103. Iner\u021bia este poate <strong>cel mai periculos factor<\/strong>, pentru c\u0103 e subtil\u0103 \u2013 nimeni nu se pl\u00e2nge direct, \u00eens\u0103 moralul \u0219i creativitatea sunt la p\u0103m\u00e2nt.
