Mai mult, termenul de transpunere (7 iunie 2026) e deja dep\u0103\u0219it, iar deocamdat\u0103 legea nu a fost promulgat\u0103 oficial.<\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">Legea ar putea fi adoptat\u0103 abia la toamn\u0103 (dup\u0103 vacan\u021ba parlamentar\u0103), dar partea important\u0103 e c\u0103 se lucreaz\u0103 la proiectul de lege, iar acum a ajuns la Senat. Fa\u021b\u0103 de forma ini\u021bial\u0103, <strong>versiunea de la Senat vine cu c\u00e2teva schimb\u0103ri<\/strong> importante pentru angajatori:<\/p>\n\n            <ul style=\"text-align: left;\">\n              <li>\u00een anun\u021burile de recrutare, nu mai e suficient s\u0103 comunici un interval salarial. Va trebui s\u0103 detaliezi \u0219i componentele variabile (bonusuri, prime, beneficii);<\/li>\n              <li>termenul de prescrip\u021bie pentru ac\u021biunile de discriminare salarial\u0103 devine clar: 3 ani, calcula\u021bi de la fapt\u0103 sau de la momentul \u00een care angajatul a aflat de ea;<\/li>\n              <li>amenzile nu mai sunt sume fixe, ci raportate la salariul minim brut: \u00eentre 3-5 salarii minime pentru \u00eenc\u0103lc\u0103ri obi\u0219nuite, 5-10 salarii minime pentru cele repetate (deci cresc automat, odat\u0103 cu salariul minim).<\/li>\n            <\/ul>\n\n            <p style=\"text-align: left; margin: 16px 0;\">Termenul legat de discriminarea salarial\u0103 e cu at\u00e2t mai important acum cu c\u00e2t, aparent, Rom\u00e2nia are cea mai mic\u0103 diferen\u021b\u0103 de remunerare \u00eentre femei \u0219i b\u0103rba\u021bi din UE: doar <strong>3,7%<\/strong>, fa\u021b\u0103 de media european\u0103 de <strong>11,1%<\/strong>. Numai c\u0103 <strong>realitatea e cu totul alta<\/strong>, a\u0219a cum arat\u0103 o <a href=\"https:\/\/www.avocatnet.ro\/articol_72233\/Romania-are-un-gender-pay-gap-de-doar-37-dar-explica%C8%9Bia-nu-e-neap%C4%83rat-egalitatea-salarial%C4%83.html\" target=\"_blank\" rel=\"noopener noreferrer\" style=\"text-decoration: underline;\" class=\"inline-link\">analiz\u0103 recent\u0103<\/a>: cifra e mic\u0103 tocmai pentru c\u0103 aproape 2 milioane de contracte de munc\u0103 din Rom\u00e2nia sunt pl\u0103tite la salariul minim.<\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">Pe sectoare, lucrurile stau \u0219i mai diferit: \u00een finan\u021be, diferen\u021ba ajunge la <strong>30,9% \u00een favoarea b\u0103rba\u021bilor<\/strong>, iar \u00een industria prelucr\u0103toare, la <strong>18,3%<\/strong>. Cu alte cuvinte, media na\u021bional\u0103 ascunde inegalit\u0103\u021bi reale exact acolo unde exist\u0103 salarii peste minim, adic\u0103 tocmai tipul de discrepan\u021be pe care legea transparen\u021bei salariale ar trebui s\u0103 le scoat\u0103 la iveal\u0103, odat\u0103 adoptat\u0103.<\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">A\u0219a c\u0103, dac\u0103 ai angaja\u021bi, folose\u0219te timpul r\u0103mas p\u00e2n\u0103 la adoptare ca s\u0103-\u021bi <strong>revizuie\u0219ti politica de remunerare<\/strong> \u0219i <strong>anun\u021burile de angajare<\/strong>, mai ales dac\u0103 lucrezi cu sisteme de bonusare sau cu beneficii variate. Noi urm\u0103rim atent subiectul \u0219i te anun\u021b\u0103m imediat ce se mai schimb\u0103 ceva.<\/p>\n\n            <div style=\"margin: 10px 0px; mso-para-margin: 0; border: none; outline: none;\">\n              <hr style=\"border-width: 0; border-top: 1px solid #1038e0; margin-top: 0; margin-bottom: 0;\" align=\"center\">\n            <\/div>\n\n            <p style=\"text-align: left; margin: 16px 0;\"><strong>Reguli noi de clasificare pentru hoteluri, pensiuni \u0219i resorturi \ud83c\udfe8<\/strong><\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">De pe <strong>8 iulie<\/strong> e \u00een vigoare un <a href=\"https:\/\/economie.gov.ro\/medat-actualizeaza-normele-de-clasificare-a-structurilor-turistice-si-simplifica-procedurile-pentru-operatorii-din-turism\/\" target=\"_blank\" rel=\"noopener noreferrer\" style=\"text-decoration: underline;\" class=\"inline-link\">ordin al Ministerului Economiei<\/a> care schimb\u0103 regulile de clasificare turistic\u0103. Astfel, dac\u0103 ai orice fel de structur\u0103 de cazare, uite ce ar trebui s\u0103 \u0219tii:<\/p>\n\n            <ul style=\"text-align: left;\">\n              <li>po\u021bi depune documenta\u021bia de clasificare online, nu doar fizic;<\/li>\n              <li>termenul pentru completarea unui dosar incomplet scade la 3 luni;<\/li>\n              <li>apartamentele de \u00eenchiriat \u00een scop turistic nu mai sunt exceptate de la obliga\u021bia de a avea site propriu \u0219i adres\u0103 de e-mail (obligatorie pentru toate structurile de 3-5 stele);<\/li>\n              <li>apare oficial conceptul de &#8222;resort turistic&#8221;, cu cerin\u021be proprii (minimum 10.000 mp, concept integrat);<\/li>\n              <li>unit\u0103\u021bi de ni\u0219\u0103 (c\u0103su\u021be pe ro\u021bi, \u00een copaci etc.) pot fi clasificate dac\u0103 \u00eendeplinesc 75% din criterii.<\/li>\n            <\/ul>\n\n            <p style=\"text-align: left; margin: 16px 0;\">Dac\u0103 ai o pensiune, un apartament de \u00eenchiriat sau o cas\u0103 unde cazezi oameni \u00een scop turistic, verific\u0103 dac\u0103 noile cerin\u021be de digitalizare (site, e-mail) \u0219i confort te afecteaz\u0103, mai ales dac\u0103 p\u00e2n\u0103 acum te bazai pe scutirile pentru apartamente.<\/p>\n\n            <div style=\"margin: 10px 0px; mso-para-margin: 0; border: none; outline: none;\">\n              <hr style=\"border-width: 0; border-top: 1px solid #1038e0; margin-top: 0; margin-bottom: 0;\" align=\"center\">\n            <\/div>\n\n            <p style=\"text-align: left; margin: 16px 0;\"><strong>ANAF vede tot mai u\u0219or cheltuielile personale trecute pe firm\u0103 \ud83d\udc5b<\/strong><\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">Ministerul Finan\u021belor a confirmat c\u0103 ANAF nu mai face controale generalizate, ci folose\u0219te <strong>analiza de risc<\/strong> pentru a g\u0103si firmele (mai ales cele mici) la care cheltuielile personale ale asociatului\/administratorului sunt trecute ca \u0219i cheltuieli ale firmei.<\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">\u0218i aici vorbim de vechiul obicei de a pune pe firm\u0103 <strong>haine<\/strong>, <strong>m\u00e2ncare<\/strong>, <strong>ma\u0219ini de lux<\/strong> etc. pentru a sc\u0103pa de taxele pe dividende. Dar vestea proast\u0103 e c\u0103 toat\u0103 digitalizarea \u0219i informatizarea ANAF face acum mult mai vizibile aceste practici, iar <strong>riscul de re\u00eencadrare<\/strong> (impozit de 16% plus dob\u00e2nzi \u0219i penalit\u0103\u021bi) e real.<\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">Ca s\u0103 te asiguri c\u0103 nu te expui la acest risc, verific\u0103 periodic, \u00eempreun\u0103 cu contabilul, ce cheltuieli treci pe firm\u0103 \u0219i dac\u0103 po\u021bi justifica leg\u0103tura lor cu activitatea economic\u0103 (mai ales la autoturisme \u0219i achizi\u021bii de valoare mare). Dac\u0103 ai avut vreodat\u0103 tenta\u021bia s\u0103 confunzi buzunarul firmei cu cel propriu, acum e un moment bun s\u0103 tai obiceiul.<\/p>\n\n            <div style=\"margin: 10px 0px; mso-para-margin: 0; border: none; outline: none;\">\n              <hr style=\"border-width: 0; border-top: 1px solid #1038e0; margin-top: 0; margin-bottom: 0;\" align=\"center\">\n            <\/div>\n\n            <p style=\"text-align: left; margin: 16px 0;\"><strong>Din 7 august, nu mai po\u021bi s\u0103 aduci muncitori din afara UE la liber \ud83d\udec2<\/strong><\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">Dac\u0103 te g\u00e2nde\u0219ti s\u0103 aduci for\u021b\u0103 de munc\u0103 din afara UE, din 7 august regulile se schimb\u0103 radical (<a href=\"https:\/\/igi.mai.gov.ro\/wp-content\/uploads\/2026\/05\/ORDONANTA-DE-URGENTA-nr.-32-din-23-aprilie-2026.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" style=\"text-decoration: underline;\" class=\"inline-link\">OUG 32\/2026<\/a>). P\u00e2n\u0103 acum, era suficient s\u0103 ai firma \u00eenfiin\u021bat\u0103 de minimum un an ca s\u0103 po\u021bi aduce muncitori NON-UE direct, pe cont propriu. De acum, asta nu mai e o op\u021biune \u0219i mai ai doar dou\u0103 c\u0103i:<\/p>\n\n            <ul style=\"text-align: left;\">\n              <li><strong>treci printr-o agen\u021bie de plasare autorizat\u0103<\/strong> \u2013 dar aceste agen\u021bii trebuie s\u0103 constituie o garan\u021bie financiar\u0103 de minimum 75.000 euro (pentru p\u00e2n\u0103 la 250 de lucr\u0103tori plasa\u021bi, sum\u0103 care cre\u0219te cu 50.000 euro la fiecare 250 de lucr\u0103tori \u00een plus), deci vorbim de juc\u0103tori mari, nu de firme mici de recrutare;<\/li>\n              <li><strong>te autorizezi tu, ca angajator, direct \u00een platform\u0103<\/strong> \u2013 dar condi\u021biile sunt greu de \u00eendeplinit: minimum 50 de angaja\u021bi, minimum 24 de luni de activitate efectiv\u0103 \u00een domeniu compatibil cu ocupa\u021bia respectiv\u0103, plus o garan\u021bie de 1.000 euro pentru fiecare lucr\u0103tor str\u0103in adus.<\/li>\n            <\/ul>\n\n            <p style=\"text-align: left; margin: 16px 0;\">Totul func\u021bioneaz\u0103 prin platforma <a href=\"https:\/\/workinromania.gov.ro\/\" target=\"_blank\" rel=\"noopener noreferrer\" style=\"text-decoration: underline;\" class=\"inline-link\">WorkinRomania.gov.ro<\/a>, care e \u00eenc\u0103 \u00een dezvoltare. Pe l\u00e2ng\u0103 asta, orice ocupa\u021bie pentru care vrei s\u0103 aduci str\u0103ini trebuie s\u0103 existe pe <strong>Lista ocupa\u021biilor deficitare<\/strong>&nbsp;care e un filtru suplimentar aflat acum \u00een lucru la Ministerul Muncii \u0219i stabile\u0219te ce meserii sunt eligibile (o ocupa\u021bie intr\u0103 pe list\u0103 dac\u0103 are minimum 20 de contracte active cu str\u0103ini \u0219i 20 de avize de angajare, \u0219i dac\u0103 nu e o func\u021bie de conducere).<\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">Altfel spus, dac\u0103 \u00een ultimul an ai adus (sau te g\u00e2ndeai s\u0103 aduci) muncitori din afara UE direct, f\u0103r\u0103 agen\u021bie, de-acum va trebui s\u0103 lucrezi exclusiv cu o agen\u021bie de plasare mare.<\/p>\n\n          <\/div>\n        <\/div>\n      <\/div>\n    <\/div>\n\n    <!-- Section: StartCo explic\u0103 -->\n    <div style=\"padding: 10px 0px; border: none; outline: none;\">\n      <div style=\"max-width: 640px; margin-left: auto; margin-right: auto; border: none; outline: none;\">\n        <div style=\"background: #eef0ff; border-radius: 10px; border: none; outline: none;\">\n          <div style=\"padding: 20px; overflow: auto; border: none; outline: none;\">\n\n            <h3 style=\"color: #0d1ad8; font-size: 18px; text-align: left; margin: 0px;\">\u23f0 <u>StartCo explic\u0103<\/u><\/h3>\n\n            <p style=\"text-align: left; margin: 16px 0;\"><strong>Cum majorezi corect un salariu minim \u00een firma ta<\/strong><\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">Dup\u0103 cum cel mai probabil ai v\u0103zut deja, de la 1 iulie 2026, salariul minim pe economie a crescut la <strong>4.325 lei<\/strong> brut, de la <strong>4.050 lei<\/strong>. Acum 2 edi\u021bii <a href=\"https:\/\/startco.ro\/newsletter\/ultima-zi-pentru-impozitul-pe-profit\/#:~:text=De%20la%201%20iulie%2C%20cre%C8%99te%20salariul%20minim%20brut%20la%204.325%20de%20lei\" target=\"_blank\" rel=\"noopener noreferrer\" style=\"text-decoration: underline;\" class=\"inline-link\">\u00ee\u021bi spuneam<\/a> pe scurt ce impact are aceast\u0103 cre\u0219tere \u0219i la ce ar trebui s\u0103 fii atent \u00een perioada imediat urm\u0103toare.<\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">\u00cen ultima vreme s-a creat mult\u0103 confuzie cu privire la majorare, tocmai pentru c\u0103 a fost comunicat\u0103 \u0219i prezentat\u0103 ca o cifr\u0103 unic\u0103 valabil\u0103 pentru orice firm\u0103 din Rom\u00e2nia. Doar c\u0103 nu e o singur\u0103 cifr\u0103. Sunt <strong>trei praguri diferite<\/strong>, iar dac\u0103 ai angaja\u021bi \u00een construc\u021bii sau \u00een agricultur\u0103\/industrie alimentar\u0103, tratarea lor ca pe acela\u0219i salariu minim te poate costa.<\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\"><strong>De ce existau reguli separate pentru construc\u021bii \u0219i agricultur\u0103?<\/strong><\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">De c\u00e2\u021biva ani, statul a stabilit salarii minime speciale (mai mari) pentru construc\u021bii \u0219i pentru agricultur\u0103\/industrie alimentar\u0103 ca stimulent, cu scutiri fiscale asociate, pentru a atrage oameni \u00een aceste domenii \u0219i a reduce munca la negru.<\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">De la 1 iulie 2026, cele dou\u0103 sectoare nu mai urmeaz\u0103 acela\u0219i regim:<\/p>\n\n            <ul style=\"text-align: left;\">\n              <li><strong>Agricultur\u0103 \u0219i industrie alimentar\u0103<\/strong> -&gt; regimul special se abrog\u0103. Salariul minim din aceste domenii se alipe\u0219te pur \u0219i simplu la salariul minim general, deci ajunge tot la 4.325 lei (nu mai exist\u0103 un prag separat).<\/li>\n              <li><strong>Construc\u021bii<\/strong> -&gt; regimul special r\u0103m\u00e2ne, <strong>neschimbat<\/strong>. Salariul minim aici este 4.582 lei brut, mai mare dec\u00e2t cel general, \u0219i HG 146\/2026 nu l-a modificat cu nimic.<\/li>\n            <\/ul>\n\n            <p style=\"text-align: left; margin: 16px 0;\"><strong>\ud83d\udccc Ce ar trebui s\u0103 faci concret, ca angajator<\/strong><\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">Primul lucru pe care trebuie s\u0103-l re\u021bii e c\u0103 salariile NU se actualizeaz\u0103 automat \u00een contracte. Legea stabile\u0219te doar plafonul minim obligatoriu, dar restul e treaba ta, \u00een trei pa\u0219i concre\u021bi:<\/p>\n\n            <ol style=\"text-align: left;\">\n              <li><strong>Identifici to\u021bi angaja\u021bii cu salariu de baz\u0103 brut sub noul minim<\/strong> aplicabil lor (4.325 lei general, 4.582 lei construc\u021bii).<\/li>\n              <li><strong>Le actualizezi salariul de baz\u0103 brut<\/strong> \u00een contract, cu efect de la 1 iulie 2026, printr-un act adi\u021bional individual, nu printr-o decizie colectiv\u0103 unic\u0103 pentru toat\u0103 firma.<\/li>\n              <li><strong>Transmi\u021bi modificarea \u00een REGES-Online p\u00e2n\u0103 pe 28 iulie 2026 cel t\u00e2rziu.<\/strong><\/li>\n            <\/ol>\n\n            <p style=\"text-align: left; margin: 16px 0;\">De\u0219i termenul de 28 iulie e foarte important, mul\u021bi \u00eel rateaz\u0103 nu pentru c\u0103 pl\u0103tesc gre\u0219it, ci pentru c\u0103 uit\u0103 de partea administrativ\u0103. Legea d\u0103 20 de zile lucr\u0103toare de la data modific\u0103rii pentru actualizarea \u00een REGES, iar pentru o modificare cu efect de la 1 iulie, asta \u00eenseamn\u0103 fix <strong>28 iulie 2026 ca dat\u0103 limit\u0103<\/strong>. Dep\u0103\u0219irea ei poate aduce <strong>amenzi \u00eentre 5.000 \u0219i 8.000 lei<\/strong> (pentru o simpl\u0103 neactualizare de sistem, nu pentru plata efectiv\u0103 gre\u0219it\u0103).<\/p>\n\n            <p style=\"text-align: left; margin: 16px 0;\">Pe l\u00e2ng\u0103 pa\u0219ii de mai sus, ar fi bine s\u0103 ai \u00een vedere \u0219i urm\u0103toarele:<\/p>\n\n            <ul style=\"text-align: left;\">\n              <li>Dac\u0103 ai contract colectiv de munc\u0103 (CCM) cu un nivel minim mai mare dec\u00e2t cel legal, negocierea porne\u0219te de la nivelul din CCM, nu de la 4.325 lei.<\/li>\n              <li>Verific\u0103 \u0219i angaja\u021bii \u021binu\u021bi la salariul minim de peste 24 de luni: legea te oblig\u0103 s\u0103 deschizi negocierea pentru o majorare real\u0103, nu simbolic\u0103.<\/li>\n              <li>Recalculeaz\u0103 suma netaxabil\u0103: de la 1 iulie scade de la 300 la 200 lei, dar plafonul de venit brut lunar pentru a beneficia de ea cre\u0219te la 4.600 lei.<\/li>\n            <\/ul>\n\n            <p style=\"text-align: left; margin: 16px 0;\">Pe scurt, legea nu prive\u0219te salariul minim ca pe o singur\u0103 cifr\u0103, ci ca pe praguri diferite, cu reguli \u0219i termene diferite.
