Exist\u0103 obliga\u021bii clare pentru ambele p\u0103r\u021bi, stabilite prin lege \u0219i prin contract.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-tipurile-de-contracte-pentru-telemunca\">Tipurile de contracte pentru telemunc\u0103<\/h2>\n\n\n\n<p><strong>1) Contract individual de munc\u0103 clasic (CIM) cu clauz\u0103 de telemunc\u0103<\/strong><\/p>\n\n\n\n<p>Acesta este un <a href=\"https:\/\/startco.ro\/blog\/contractul-de-munca-ce-clauze-trebuie-sa-contina-model-pentru-prima-angajare\/\" target=\"_blank\" rel=\"noreferrer noopener\">contract individual de munc\u0103<\/a> standard \u00een care se adaug\u0103 o clauz\u0103 specific\u0103 ce prevede posibilitatea desf\u0103\u0219ur\u0103rii muncii \u00een regim de telemunc\u0103 pentru anumite perioade sau \u00een anumite condi\u021bii.<\/p>\n\n\n\n<p><strong>Avantaje:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Flexibilitate mare pentru ambele p\u0103r\u021bi<\/li>\n\n\n\n<li>Nu necesit\u0103 modific\u0103ri majore ale contractului existent<\/li>\n\n\n\n<li>Se poate implementa rapid prin act class=\"wp-block-heading\" id=\"h-care-sunt-cheltuielile-in-telemunca\">Care sunt cheltuielile \u00een telemunc\u0103?<\/h2>\n\n\n\n<p>Una dintre cele mai importante aspecte care trebuie reglementate \u00een contractul de telemunc\u0103 este repartizarea cheltuielilor \u00eentre angajator \u0219i angajat.<\/p>\n\n\n\n<p><strong>Cheltuieli care pot fi suportate de angajator:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Echipamentele de lucru (laptop, telefon, imprimant\u0103, scaun ergonomic)<\/li>\n\n\n\n<li>Software-urile necesare activit\u0103\u021bii<\/li>\n\n\n\n<li>Abonamentul de internet sau o sum\u0103 forfetar\u0103 pentru internet<\/li>\n\n\n\n<li>Consumul suplimentar de energie electric\u0103 (calculat pe baza orelor de lucru)<\/li>\n\n\n\n<li>Consumabile (h\u00e2rtie, cartu\u0219e, rechizite de birou)<\/li>\n\n\n\n<li>Cheltuieli de comunica\u021bii (telefon fix\/mobil \u00een interes de serviciu)<\/li>\n<\/ul>\n\n\n\n<p><strong>Cheltuieli care r\u0103m\u00e2n de obicei \u00een sarcina angajatului:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Chiria sau costurile locuin\u021bei folosite ca spa\u021biu de lucru<\/li>\n\n\n\n<li>Consumul de baz\u0103 de energie electric\u0103<\/li>\n\n\n\n<li>Mobilierul personal (dac\u0103 nu este furnizat de angajator)<\/li>\n<\/ul>\n\n\n\n<p><strong>Important:<\/strong> Toate aceste aspecte trebuie stabilite clar \u00een contract pentru a evita conflictele ulterioare. Mul\u021bi angajatori aleg s\u0103 acorde o sum\u0103 forfetar\u0103 lunar\u0103 pentru acoperirea par\u021bial\u0103 a cheltuielilor de telemunc\u0103 (dar re\u021bine ca suma forfetar\u0103 de p\u00e2n\u0103 la 400 lei\/lun\u0103 pentru telemunc\u0103 f\u0103r\u0103 documente a fost eliminat\u0103 \u00eencep\u00e2nd cu 2024, prin OUG 115\/2023).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-sanatatea-\u0219i-securitatea-in-munca-pentru-telemunca\"><strong>S\u0103n\u0103tatea \u0219i securitatea \u00een munc\u0103 pentru telemunc\u0103<\/strong><\/h2>\n\n\n\n<p>Legea prevede c\u0103 angajatorul are obliga\u021bii specifice \u0219i pentru angaja\u021bii care lucreaz\u0103 \u00een regim de telemunc\u0103.<\/p>\n\n\n\n<p><strong>Ce trebuie s\u0103 fac\u0103 angajatorul:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>S\u0103 informeze angajatul despre riscurile pentru s\u0103n\u0103tate specifice telemuncii<\/li>\n\n\n\n<li>S\u0103 organizeze instruiri SSM adaptate pentru munca de la distan\u021b\u0103<\/li>\n\n\n\n<li>S\u0103 verifice respectarea normelor de ergonomie la locul de munc\u0103 de acas\u0103 (prin vizite la domiciliu sau prin auto-evaluare)<\/li>\n\n\n\n<li>S\u0103 se asigure c\u0103 angajatul are acces la echipamente ergonomice (scaun, birou, suport laptop)<\/li>\n\n\n\n<li>S\u0103 monitorizeze respectarea programului de lucru pentru evitarea suprasolicit\u0103rii<\/li>\n\n\n\n<li>S\u0103 organizeze controale medicale periodice<\/li>\n<\/ul>\n\n\n\n<p><strong>Obliga\u021bii pentru angajat:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>S\u0103 respecte instruc\u021biunile primite privind SSM<\/li>\n\n\n\n<li>S\u0103 amenajeze un spa\u021biu de lucru sigur \u0219i ergonomic<\/li>\n\n\n\n<li>S\u0103 raporteze orice accident de munc\u0103 sau incident<\/li>\n\n\n\n<li>S\u0103 participe la instruirile SSM organizate de angajator<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-ce-se-intampla-daca-un-angajat-trece-de-la-birou-la-telemunca\">Ce se \u00eent\u00e2mpl\u0103 dac\u0103 un angajat trece de la birou la telemunc\u0103?<\/h2>\n\n\n\n<p>Ai un angajat care lucreaz\u0103 de la birou \u0219i vrea s\u0103 treac\u0103 la remote sau hibrid? Alegerea tipului potrivit de contract &#8211; CIM clasic, CIM cu clauz\u0103 de telemunc\u0103 sau CIM de telemunc\u0103 &#8211; depinde de specificul activit\u0103\u021bii tale \u0219i de nevoile angajatului.<\/p>\n\n\n\n<p><strong>Re\u021bine:<\/strong> accordul verbal nu este suficient, iar improviza\u021bia te poate costa scump. Investe\u0219te timpul necesar pentru a formaliza corect regimul de telemunc\u0103 prin contracte clare \u0219i complete.
