Are trei angaja\u021bi implica\u021bi \u00een proiect: unul merge 5 zile pentru \u00eent\u00e2lniri \u0219i workshopuri, altul st\u0103 4 luni la client pentru implementare, iar al treilea merge periodic pentru suport \u0219i testare. <\/p>\n\n\n\n<p>Pentru toate aceste situa\u021bii, firma trebuie s\u0103 stabileasc\u0103 corect cadrul juridic \u0219i fiscal: ce tip de deplasare folose\u0219te, dac\u0103 are nevoie de A1, cum trateaz\u0103 indemniza\u021biile \u0219i ce obliga\u021bii suplimentare apar \u00een statul gazd\u0103.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-delegare-vs-deta\u0219are-vs-deta\u0219are-transna\u021bionala\">Delegare vs deta\u0219are vs deta\u0219are transna\u021bional\u0103<\/h2>\n\n\n\n<p id=\"h-ce-este-delegarea\"><strong>1) Ce este delegarea?<\/strong><\/p>\n\n\n\n<p><strong>Delegarea<\/strong> reprezint\u0103 exercitarea temporar\u0103 de c\u0103tre salariat a unor lucr\u0103ri sau sarcini corespunz\u0103toare atribu\u021biilor sale de serviciu \u00een afara locului de munc\u0103, la dispozi\u021bia angajatorului. <\/p>\n\n\n\n<p>Altfel spus, delegarea este situa\u021bia \u00een care angajatorul trimite temporar salariatul s\u0103 \u00ee\u0219i fac\u0103 treaba \u00een alt loc dec\u00e2t locul obi\u0219nuit de munc\u0103, dar raportul de munc\u0103 r\u0103m\u00e2ne la acela\u0219i angajator. Nu vorbim despre schimbarea angajatorului, ci despre o deplasare temporar\u0103 pentru \u00eendeplinirea atribu\u021biilor de serviciu.<\/p>\n\n\n\n<p><strong>Caracteristici principale ale deleg\u0103rii:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Durat\u0103 limitat\u0103<\/strong>: Maxim 60 de zile calendaristice \u00een 12 luni (poate fi prelungit\u0103 cu acordul salariatului)<\/li>\n\n\n\n<li><strong>Rela\u021bia contractual\u0103<\/strong>: R\u0103m\u00e2ne neschimbat\u0103, angajatul continu\u0103 s\u0103 lucreze sub autoritatea angajatorului rom\u00e2n<\/li>\n\n\n\n<li><strong>Atribu\u021bii<\/strong>: Similar cu cele din <a href=\"https:\/\/startco.ro\/blog\/cum-faci-o-angajare\/\" target=\"_blank\" rel=\"noreferrer noopener\">fi\u0219a postului<\/a><\/li>\n\n\n\n<li><strong>Salarizare<\/strong>: Angajatul prime\u0219te salariul de la angajatorul rom\u00e2n + indemniza\u021bie de delegare (diurn\u0103)<\/li>\n\n\n\n<li><strong>Document principal<\/strong>: Ordin de deplasare<\/li>\n<\/ul>\n\n\n\n<p>\u00cen exemplul nostru, angajatul Tehnova care merge 5 zile \u00een Germania pentru workshopuri \u0219i \u00eent\u00e2lniri cu clientul este, de regul\u0103, \u00eentr-o delegare. Tot Tehnova \u00eei d\u0103 sarcinile, tot Tehnova \u00eel pl\u0103te\u0219te, iar deplasarea este temporar\u0103 \u0219i legat\u0103 de activitatea lui obi\u0219nuit\u0103.<\/p>\n\n\n\n<p id=\"h-ce-este-deta\u0219area\"><strong>2) Ce este deta\u0219area?<\/strong><\/p>\n\n\n\n<p><strong>Deta\u0219area<\/strong> reprezint\u0103 schimbarea temporar\u0103 a locului de munc\u0103, din dispozi\u021bia angajatorului, la un alt angajator, pentru executarea unor lucr\u0103ri \u00een interesul acestuia.<\/p>\n\n\n\n<p>Deci salariatul lucreaz\u0103 temporar la un alt angajator. Aici discu\u021bia nu mai este doar despre schimbarea locului de munc\u0103, ci despre faptul c\u0103 munca este prestat\u0103 pentru un alt angajator, iar salariatul beneficiaz\u0103 de drepturile care \u00eei sunt mai favorabile. Dac\u0103 angajatorul la care s-a dispus deta\u0219area nu \u00ee\u0219i \u00eendepline\u0219te obliga\u021biile, angajatorul care a dispus deta\u0219area r\u0103m\u00e2ne, \u00een ultim\u0103 instan\u021b\u0103, responsabil pentru drepturile salariatului.<\/p>\n\n\n\n<p><strong>Caracteristici principale ale deta\u0219\u0103rii:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Durat\u0103<\/strong>: Maxim 1 an (poate fi prelungit\u0103 cu acordul p\u0103r\u021bilor, din 6 \u00een 6 luni)<\/li>\n\n\n\n<li><strong>Rela\u021bia contractual\u0103<\/strong>: Se modific\u0103 temporar, angajatul lucreaz\u0103 sub autoritatea entit\u0103\u021bii la care este deta\u0219at<\/li>\n\n\n\n<li><strong>Atribu\u021bii<\/strong>: Pot diferi de cele din fi\u0219a postului ini\u021bial\u0103<\/li>\n\n\n\n<li><strong>Salarizare<\/strong>: Poate fi pl\u0103tit de angajatorul ini\u021bial sau de cel la care este deta\u0219at<\/li>\n\n\n\n<li><strong>Document principal<\/strong>: Decizie de deta\u0219are + act adi\u021bional la contractul de munc\u0103; Detasarea se transmite in Reges.<\/li>\n<\/ul>\n\n\n\n<p><strong>3) Ce este deta\u0219area transna\u021bional\u0103?<\/strong><\/p>\n\n\n\n<p>Pe l\u00e2ng\u0103 regulile din Codul muncii, exist\u0103 \u0219i deta\u0219area transna\u021bional\u0103, reglementat\u0103 distinct prin Legea nr. 16\/2017. Aceasta apare, \u00een esen\u021b\u0103, \u00een contextul prest\u0103rii transfrontaliere de servicii, c\u00e2nd o firm\u0103 din Rom\u00e2nia trimite salaria\u021bi s\u0103 lucreze temporar \u00eentr-un alt stat membru \u00een cadrul unui contract de servicii, al unei deta\u0219\u0103ri intragrup sau prin agent de munc\u0103 temporar\u0103. <\/p>\n\n\n\n<p>\u00cen acest caz, pe l\u00e2ng\u0103 regulile rom\u00e2ne\u0219ti, trebuie respectate \u0219i o serie de condi\u021bii obligatorii din statul gazd\u0103, inclusiv cele privind remunera\u021bia \u0219i alte condi\u021bii de munc\u0103 aplicabile acolo.<\/p>\n\n\n\n<p>Pentru firmele de servicii, IT, construc\u021bii, mentenan\u021b\u0103, instal\u0103ri, consultan\u021b\u0103 tehnic\u0103 sau produc\u021bie, asta este adesea categoria care conteaz\u0103 \u00een practic\u0103. Cu alte cuvinte: nu e suficient s\u0103 te \u00eentrebi doar \u201edelegare sau deta\u0219are?\u201d, ci \u0219i dac\u0103 situa\u021bia ta intr\u0103 sau nu \u00een zona de posting transna\u021bional.<\/p>\n\n\n\n<p><strong>De re\u021binut:<\/strong> dac\u0103 deta\u0219area transna\u021bional\u0103 dep\u0103\u0219e\u0219te <strong>12 luni<\/strong>, iar \u00een anumite condi\u021bii notificarea motivat\u0103 poate extinde pragul la <strong>18 luni<\/strong>, se l\u0103rge\u0219te pachetul de condi\u021bii de munc\u0103 din statul gazd\u0103 care devin aplicabile lucr\u0103torului.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-cum-faci-alegerea-corecta\">Cum faci alegerea corect\u0103?<\/h2>\n\n\n\n<p>C\u00e2nd alegi \u00eentre delegare, deta\u0219are sau deta\u0219are transna\u021bional\u0103, o regul\u0103 util\u0103 este s\u0103 pleci de la trei \u00eentreb\u0103ri simple:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Salariatul r\u0103m\u00e2ne sub autoritatea firmei din Rom\u00e2nia?<\/strong>\n<ul class=\"wp-block-list\">\n<li>Dac\u0103 da, cel mai probabil nu e deta\u0219are clasic\u0103 la alt angajator. Poate fi delegare sau deta\u0219are transna\u021bional\u0103, \u00een func\u021bie de context.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Munca este prestat\u0103 pentru executarea unui contract de servicii \u00een alt stat?<\/strong>\n<ul class=\"wp-block-list\">\n<li>Dac\u0103 da, trebuie s\u0103 verifici serios dac\u0103 intri \u00een sfera deta\u0219\u0103rii transna\u021bionale \u0219i a regulilor statului gazd\u0103.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Vrei ca salariatul s\u0103 r\u0103m\u00e2n\u0103 asigurat \u00een Rom\u00e2nia?<\/strong>\n<ul class=\"wp-block-list\">\n<li>Dac\u0103 da, pentru UE\/SEE\/Elve\u021bia, formularul A1 devine esen\u021bial.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<p>\u00cen practic\u0103, o deplasare de c\u00e2teva zile pentru \u00eent\u00e2lniri, training sau workshopuri va fi de multe ori delegare. O prezen\u021b\u0103 mai lung\u0103 la client, \u00een baza unui contract de servicii, poate \u00eensemna deta\u0219are transna\u021bional\u0103. Iar deta\u0219area clasic\u0103, \u00een sens strict, r\u0103m\u00e2ne acea situa\u021bie \u00een care salariatul merge temporar la un alt angajator, \u00een interesul acestuia.<\/p>\n\n\n\n<p>Pentru Tehnova SRL, alegerea \u00eentre delegare \u0219i deta\u0219are depinde de:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Durata \u0219ederii<\/strong>: Pentru perioadele sub 60 de zile, delegarea este op\u021biunea simpl\u0103<\/li>\n\n\n\n<li><strong>Natura muncii<\/strong>: Dac\u0103 angaja\u021bii continu\u0103 s\u0103 primeasc\u0103 instruc\u021biuni de la Tehnova \u0219i nu de la clientul german<\/li>\n\n\n\n<li><strong>Structura contractual\u0103<\/strong>: Dac\u0103 exist\u0103 un <a href=\"https:\/\/startco.ro\/blog\/cum-prestezi-servicii-pentru-un-client-din-afara-romaniei\/\" target=\"_blank\" rel=\"noreferrer noopener\">contract de prest\u0103ri servicii<\/a> (nu de punere la dispozi\u021bie a personalului)<\/li>\n<\/ul>\n\n\n\n<p>\u00cen majoritatea cazurilor de implementare de proiecte IT, formula corect\u0103 este <strong>delegarea<\/strong> (pentru perioade scurte) sau <strong>deta\u0219area transna\u021bional\u0103<\/strong> (pentru perioade mai lungi).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-ce-este-formularul-a1-\u0219i-cand-ai-nevoie-de-el\">Ce este formularul A1 \u0219i c\u00e2nd ai nevoie de el?<\/h2>\n\n\n\n<p>Formularul A1 este un certificat care atest\u0103 c\u0103 angajatul r\u0103m\u00e2ne asigurat \u00een sistemul de securitate social\u0103 din Rom\u00e2nia \u00een timp ce lucreaz\u0103 temporar \u00een alt stat membru UE\/SEE\/Elve\u021bia. Acest formular demonstreaz\u0103 c\u0103:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Angajatul pl\u0103te\u0219te contribu\u021bii sociale doar \u00een Rom\u00e2nia<\/li>\n\n\n\n<li>Nu trebuie s\u0103 contribuie la sistemul de securitate social\u0103 din \u021bara gazd\u0103<\/li>\n<\/ul>\n\n\n\n<p id=\"h-cand-este-necesar-formularul-a1\"><strong><strong>C\u00e2nd este necesar formularul A1?<\/strong><\/strong><\/p>\n\n\n\n<p>Formularul A1 este necesar \u00een urm\u0103toarele situa\u021bii:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pentru <strong>deta\u0219area<\/strong> angaja\u021bilor \u00eentr-un stat UE\/SEE\/Elve\u021bia (nu pentru delegare)<\/li>\n\n\n\n<li>Indiferent de durata deplas\u0103rii (chiar \u0219i pentru deplas\u0103ri de c\u00e2teva zile)<\/li>\n\n\n\n<li>Pentru toate tipurile de activit\u0103\u021bi profesionale<\/li>\n<\/ul>\n\n\n\n<p><strong>De re\u021binut:<\/strong> lipsa formularului A1 poate duce la obliga\u021bia de a pl\u0103ti contribu\u021bii sociale \u00een \u021bara gazd\u0103, \u00een plus fa\u021b\u0103 de cele din Rom\u00e2nia!<\/p>\n\n\n\n<p>A\u0219adar, pentru un angajat care merge temporar \u00eentr-un alt stat membru, chiar \u0219i pentru o misiune scurt\u0103, conferin\u021be, \u00eent\u00e2lniri, t\u00e2rguri sau training, abordarea prudent\u0103 este s\u0103 verifici dac\u0103 trebuie emis A1 \u0219i s\u0103 nu porne\u0219ti de la ideea c\u0103 la delegare nu se aplic\u0103 niciodat\u0103.<\/p>\n\n\n\n<p>Mai e util de re\u021binut c\u0103 A1 nu este permis de munc\u0103. El \u021bine de contribu\u021biile sociale, nu de dreptul de intrare sau de \u0219edere \u0219i nici nu \u00eenlocuie\u0219te alte formalit\u0103\u021bi cerute de statul gazd\u0103.<\/p>\n\n\n\n<p id=\"h-cum-se-ob\u021bine-formularul-a1\"><strong><strong>Cum se ob\u021bine formularul A1?<\/strong><\/strong><\/p>\n\n\n\n<p>Pa\u0219ii pentru ob\u021binerea formularului A1:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Completarea cererii-tip (disponibil\u0103 pe site-ul Casei Na\u021bionale de Pensii Publice)<\/li>\n\n\n\n<li>Depunerea cererii la Casa Jude\u021bean\u0103 de Pensii din jude\u021bul \u00een care firma are sediul social<\/li>\n\n\n\n<li>Furnizarea documentelor justificative:\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/startco.ro\/blog\/contractul-de-munca-ce-clauze-trebuie-sa-contina-model-pentru-prima-angajare\/\" target=\"_blank\" rel=\"noreferrer noopener\">Contract de munc\u0103<\/a><\/li>\n\n\n\n<li>Decizie de deta\u0219are<\/li>\n\n\n\n<li>Contract cu partenerul str\u0103in<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Termenul legal de eliberare: 30 de zile (\u00een practic\u0103 poate dura 10-15 zile)<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-deducerea-cheltuielilor-de-delegare-sau-deta\u0219are\">Deducerea cheltuielilor de delegare sau deta\u0219are<\/h2>\n\n\n\n<p id=\"h-1-diurna-reguli-\u0219i-limite-de-deductibilitate\"><strong>1) Diurna: Reguli \u0219i limite de deductibilitate<\/strong><\/p>\n\n\n\n<p>Diurna reprezint\u0103 suma zilnic\u0103 acordat\u0103 angajatului pentru acoperirea cheltuielilor personale \u00een timpul deleg\u0103rii\/deta\u0219\u0103rii. Indemniza\u021bia de delegare este \u00een prezent de 23 lei\/zi, iar acela\u0219i reper de 23 lei\/zi exist\u0103 \u0219i pentru indemniza\u021bia de deta\u0219are.<\/p>\n\n\n\n<p>Asta \u00eenseamn\u0103 c\u0103 primul plafon fiscal pentru deplas\u0103rile interne este de 2,5 x 23 lei\/zi = 57,5 lei\/zi. Dar suma neimpozabil\u0103 nu se stabile\u0219te doar prin regula de 2,5 ori. E nevoie \u0219i de verificarea \u0219i a celui de-al doilea plafon, adic\u0103 limita reprezent\u00e2nd 3 salarii de baz\u0103 corespunz\u0103toare locului de munc\u0103 ocupat, raportat\u0103 la num\u0103rul de zile lucr\u0103toare din luna respectiv\u0103 \u0219i \u00eenmul\u021bit\u0103 cu num\u0103rul de zile de delegare sau deta\u0219are. <\/p>\n\n\n\n<p>Cu alte cuvinte, plafonul fiscal real este minimul dintre cele dou\u0103 limite. Ce dep\u0103\u0219e\u0219te acest plafon devine venit salarial impozabil \u0219i intr\u0103 \u00een baza contribu\u021biilor.<\/p>\n\n\n\n<p><strong>Limite de deductibilitate pentru diurn\u0103:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u00cen \u021bar\u0103<\/strong>: maxim 57,5lei\/zi\/persoan\u0103<\/li>\n\n\n\n<li><strong>\u00cen str\u0103in\u0103tate<\/strong>: 2,5 ori diurna legal\u0103 stabilit\u0103 pentru \u021bara respectiv\u0103 (HG nr. 518\/1995)<\/li>\n<\/ul>\n\n\n\n<p>Pentru deplas\u0103rile \u00een Germania, limita pentru institu\u021biile publice este de 35 euro\/zi, deci:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Limita de deductibilitate pentru firmele private: 35 x 2,5 = 87,5 euro\/zi\/persoan\u0103<\/li>\n<\/ul>\n\n\n\n<p><strong>Tratamentul fiscal al diurnei:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Este deductibil\u0103 la calculul impozitului pe profit\/venit \u00een limitele de mai sus<\/li>\n\n\n\n<li>Este neimpozabil\u0103 pentru angajat \u00een limitele legale<\/li>\n\n\n\n<li>Sumele care dep\u0103\u0219esc limitele legale sunt considerate venituri salariale \u0219i se impoziteaz\u0103 corespunz\u0103tor<\/li>\n<\/ul>\n\n\n\n<p>Mai exist\u0103 \u0219i regula de frac\u021bionare a diurnei externe: pentru o perioad\u0103 de p\u00e2n\u0103 la 12 ore se acord\u0103 50% din diurn\u0103, iar pentru peste 12 ore se acord\u0103 100%. De asemenea, dac\u0103 masa este asigurat\u0103 integral de partenerul extern, regulile pentru sectorul public prev\u0103d acordarea a 50% din diurn\u0103. <\/p>\n\n\n\n<p>\u00cen deta\u0219area transna\u021bional\u0103, indemniza\u021bia specific\u0103 trebuie privit\u0103 cu aten\u021bie. Legea nr. 16\/2017 prevede c\u0103 indemniza\u021bia specific\u0103 deta\u0219\u0103rii transna\u021bionale face parte din remunera\u021bie, cu excep\u021bia p\u0103r\u021bii acordate cu titlu de rambursare a cheltuielilor generate efectiv de deta\u0219are, cum ar fi transportul, cazarea \u0219i masa. <\/p>\n\n\n\n<p>Asta \u00eenseamn\u0103 c\u0103 nu po\u021bi masca pur \u0219i simplu obliga\u021biile salariale din statul gazd\u0103 \u00eentr-o diurn\u0103 tratat\u0103 generic. Dac\u0103 statul gazd\u0103 cere un anumit nivel de remunera\u021bie minim\u0103 pentru tipul respectiv de activitate, trebuie s\u0103 te asiguri c\u0103 structura de plat\u0103 respect\u0103 acele reguli.
