Practic, dac\u0103 ai echipe pe teren sau mai multe puncte de lucru, e util s\u0103 ai un mini-dosar la loca\u021bie: copie CIM + fi\u0219a postului + dovada instruirii SSM\/PSI (\u00een func\u021bie de organizarea ta intern\u0103).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-ce-trebuie-sa-con\u021bina-dosarul-personal-al-salariatului\">Ce trebuie s\u0103 con\u021bin\u0103 dosarul personal al salariatului?<\/h2>\n\n\n\n<p>Conform HG 295\/2025, exista o list\u0103 minim\u0103: acte de angajare, CIM, acte adi\u021bionale, documente de studii\/calific\u0103ri \u0219i documente care justific\u0103 legalitatea complet\u0103rii \u00een registru. Dar pentru un dosar curat la control, e mai u\u0219or s\u0103-l structurezi pe etape:<\/p>\n\n\n\n<p id=\"h-1-documente-inainte-in-momentul-angajarii-acte-de-baza\"><strong>1) Documente \u00eenainte\/<a href=\"https:\/\/startco.ro\/blog\/cum-faci-o-angajare\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u00een momentul angaj\u0103rii<\/a> (acte de baz\u0103)<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>copie CI\/pa\u0219aport + documente de stare civil\u0103 (unde e cazul)<\/li>\n\n\n\n<li>CV \/ cerere angajare (dac\u0103 le colectezi)<\/li>\n\n\n\n<li>copii acte de studii \/ calific\u0103ri \/ atestate (\u00een copie, nu original)<\/li>\n\n\n\n<li>aviz de angajare \/ permis de munc\u0103 (pentru non-UE, dac\u0103 e cazul)<\/li>\n\n\n\n<li><strong>fi\u0219a de aptitudine<\/strong> de la medicina muncii (un exemplar r\u0103m\u00e2ne la angajator)<\/li>\n\n\n\n<li>fi\u0219a de instruire SSM (\u0219i, dup\u0103 caz, PSI\/SU) \u2013 \u021binut\u0103 de la angajare p\u00e2n\u0103 la \u00eencetarea raporturilor de munc\u0103<\/li>\n\n\n\n<li>cazier judiciar (doar dac\u0103 func\u021bia\/legisla\u021bia \u00eel cere \u2013 ex. gestiune)<\/li>\n<\/ul>\n\n\n\n<p id=\"h-2-documente-intocmite-la-angajare\"><strong>2) Documente \u00eentocmite la angajare<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><a href=\"https:\/\/startco.ro\/blog\/contractul-de-munca-ce-clauze-trebuie-sa-contina-model-pentru-prima-angajare\/\" target=\"_blank\" rel=\"noreferrer noopener\">Contract individual de munc\u0103 (CIM)<\/a><\/strong> semnat<\/li>\n\n\n\n<li>fi\u0219a postului (ideal semnat\u0103 de salariat)<\/li>\n\n\n\n<li>informare\/consim\u021b\u0103m\u00e2nt (unde e cazul) pentru prelucrarea datelor \u2013 aici \u021bine de modul \u00een care implementezi GDPR, dar e foarte des cerut\u0103 \u00een practic\u0103<\/li>\n\n\n\n<li>decizii\/\u00eenscrisuri interne (ex. \u00eencadrare, program, deleg\u0103ri), dac\u0103 ai astfel de proceduri<\/li>\n<\/ul>\n\n\n\n<p><strong>3) Pe parcursul contractului<\/strong> <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>acte adi\u021bionale (salariu, func\u021bie, norm\u0103, program, telemunc\u0103 etc.)<\/li>\n\n\n\n<li>decizii de suspendare \/ \u00eencetare suspendare (concedii, absen\u021be, alte situa\u021bii)<\/li>\n\n\n\n<li>cereri concediu (odihn\u0103 \/ f\u0103r\u0103 plat\u0103), aprob\u0103ri, planific\u0103ri (dac\u0103 le folose\u0219ti)<\/li>\n\n\n\n<li>evalu\u0103ri, avertismente, cercet\u0103ri disciplinare (dac\u0103 exist\u0103)<\/li>\n\n\n\n<li>instruiri periodice SSM + actualiz\u0103ri (c\u00e2nd se fac)<\/li>\n<\/ul>\n\n\n\n<p><strong>4) La \u00eencetarea contractului<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>adeverin\u021b\u0103<\/strong> cu activitatea, durata, salariul, vechimea etc.<\/li>\n\n\n\n<li><strong>extras din Registru (REGES-ONLINE)<\/strong>, certificat potrivit legii<\/li>\n<\/ul>\n\n\n\n<p><strong>De re\u021binut:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La cererea salariatului sau fostului salariat, copiile\/adeverin\u021bele trebuie eliberate \u00een <strong>maximum 15 zile lucr\u0103toare<\/strong>.<\/li>\n\n\n\n<li>Dosarul de salariat trebuie s\u0103 includ\u0103 documentele \u00een copie, originalul fiind proprietatea salariatului. Nu trebuie s\u0103 re\u021bii \u00een original actele de identitate \u0219i nici diplomele\/certificatele de studii\/calific\u0103ri ale angaja\u021bilor.<\/li>\n\n\n\n<li>Po\u021bi include la dosarul personal al salariatului \u0219i aspecte negative ale activit\u0103\u021bii acestuia.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-cine-trebuie-sa-intocmeasca-\u0219i-sa-\u021bina-documentele-de-angajare-nbsp\">Cine trebuie s\u0103 \u00eentocmeasc\u0103 (\u0219i s\u0103 \u021bin\u0103) documentele de angajare?&nbsp;<\/h2>\n\n\n\n<p>Completarea \u0219i p\u0103strarea dosarelor personale ale salaria\u021bilor se face, conform legii, de c\u0103tre persoana responsabil\u0103 cu p\u0103strarea dosarelor personale numit\u0103 prin decizie scris\u0103 de c\u0103tre angajator sau de c\u0103tre persoana cu atribu\u021bii stabilite prin fi\u0219a postului (exemplu: director de resurse umane).<\/p>\n\n\n\n<p>De regul\u0103, \u00eentr-o firm\u0103 mic\u0103, de \u00eentocmirea dosarului de salariat se ocup\u0103 <a href=\"https:\/\/startco.ro\/blog\/ce-este-administratorul-unui-srl-si-care-sunt-drepturile-si-responsabilitatile-sale\/\" target=\"_blank\" rel=\"noreferrer noopener\">administratorul firmei<\/a>. \u00cen schimb, \u00een firmele medii sau mari:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>exist\u0103 <strong>departament <\/strong>de resurse umane, cu personal angajat pentru aceste sarcini de salarizare<\/li>\n\n\n\n<li>sau sunt stabilite <strong>contracte de prest\u0103ri servicii cu <a href=\"https:\/\/startco.ro\/contabilitate\" target=\"_blank\" rel=\"noreferrer noopener\">firme specializate \u00een resurse umane<\/a><\/strong>, care \u00eentocmesc aceste dosare de personal.<\/li>\n<\/ul>\n\n\n\n<p>Important este s\u0103 existe <strong>o responsabilitate clar\u0103<\/strong> \u0219i s\u0103 po\u021bi pune dosarul la dispozi\u021bie rapid, mai ales c\u0103 acum este cerut \u00een <strong>format electronic<\/strong>.<\/p>\n\n\n\n<p>C\u00e2nd vine vorba de p\u0103strare, a\u0219a cum \u00ee\u021bi spuneam \u0219i mai sus, \u00een func\u021bie de locul de unde \u00ee\u0219i desf\u0103\u0219oar\u0103 activitatea angajatul (conform CIM), dosarul de salariat va fi p\u0103strat la sediul social sau la punctul de lucru. \u00cen plus, \u00een momentul \u00eencet\u0103rii contractului de munc\u0103, dosarul de salariat va fi arhivat de c\u0103tre firm\u0103.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-cum-se-arhiveaza-dosarul-personal-al-salariatului\">Cum se arhiveaz\u0103 dosarul personal al salariatului?<\/h2>\n\n\n\n<p>Cand vine vorba de dosarul personal al salariatului in format electronic, HG 295\/2025 trimite la regulile de arhivare electronic\u0103:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>acces controlat (cine vede dosarele \u0219i de ce)<\/li>\n\n\n\n<li>integritate (s\u0103 po\u021bi demonstra c\u0103 documentul nu a fost modificat)<\/li>\n\n\n\n<li>back-up + versionare (\u00een caz de incident)<\/li>\n\n\n\n<li>arhivare electronic\u0103 \u00een sensul legii (c\u00e2nd vorbim de documente electronice arhivate, Legea 135\/2007 are cerin\u021be despre semnare\/identificare \u0219i eviden\u021b\u0103 \u00een arhiv\u0103).<\/li>\n<\/ul>\n\n\n\n<p>Majoritatea firmelor folosesc un sistem de document management + <a href=\"https:\/\/startco.ro\/blog\/ce-este-semnatura-electronica-digitala\/\" target=\"_blank\" rel=\"noreferrer noopener\">semn\u0103tur\u0103 electronic\u0103<\/a> + politici clare de acces. Important e s\u0103 po\u021bi demonstra trasabilitatea documentelor, nu doar s\u0103 ai un folder cu PDF-uri.<\/p>\n\n\n\n<p>\u00cen cazul arhivei fizice, durata exact\u0103 se stabile\u0219te prin nomenclatorul arhivistic al angajatorului, \u00een logica Legii Arhivelor. Un reper folosit frecvent \u00een practic\u0103 este cel din Anexa 6 a Legii 16\/1996 (dosarele personale \u2013 dup\u0103 75 de ani).<\/p>\n\n\n\n<p>Legea 36\/2023 a modificat Legea contabilit\u0103\u021bii \u0219i stabile\u0219te c\u0103 registrele \u0219i documentele justificative se p\u0103streaz\u0103 <strong>5 ani<\/strong> (calcula\u021bi de la 1 iulie a anului urm\u0103tor), <strong>inclusiv pentru statele de salarii<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-ce-trebuie-sa-mai-\u0219tii-despre-dosarul-personal-al-salariatului\">Ce trebuie s\u0103 mai \u0219tii despre dosarul personal al salariatului?<\/h2>\n\n\n\n<p id=\"h-ce-se-intampla-in-cazul-in-care-firma-se-inchide\"><strong>1) Ce se \u00eent\u00e2mpl\u0103 \u00een cazul \u00een care firma se \u00eenchide?<\/strong><\/p>\n\n\n\n<p>Conform art. 18 alin. (1) din Legea Arhivelor Na\u021bionale nr. 16\/1996 \u00een cazul \u00een care firma se \u00eenchide ca urmare a declar\u0103rii falimentului\/dizolv\u0103rii, \u00een condi\u021biile legii conform art. 2, documentele din dosarul de salariat se preiau de Arhivele Na\u021bionale sau de serviciile jude\u021bene\/Serviciul Municipiului Bucure\u0219ti ale\/al Arhivelor Na\u021bionale.<\/p>\n\n\n\n<p>Astfel, <strong>arhiva (fizic\u0103 sau electronic\u0103) se \u021bine \u00een cadrul firmei, pe toat\u0103 durata func\u021bion\u0103rii sale<\/strong>. Dac\u0103 firma \u00ee\u0219i <strong>\u00eenceteaz\u0103 activitatea trebuie s\u0103 predea documentele<\/strong> unui operator economic autorizat \u00een prestarea de servicii arhivistice.&nbsp;<\/p>\n\n\n\n<p><strong>2) Amenzi \u0219i riscuri<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Dac\u0103 nu p\u0103strezi dosarul personal la sediu \/ sediu secundar (unde e delegat\u0103 angajarea): <strong>3.000 \u2013 6.000 lei<\/strong>.<\/li>\n\n\n\n<li>Dac\u0103 nu respec\u021bi obliga\u021biile legate de eliberarea copiilor\/adeverin\u021belor\/extraselor (art. 8 alin. 4\u20138 HG 295\/2025): <strong>3.000 \u2013 5.000 lei<\/strong>.<\/li>\n\n\n\n<li>Dac\u0103 nu ai <strong>copie CIM la locul de munc\u0103<\/strong>: amend\u0103 <strong>10.000 lei<\/strong> (Codul muncii).<\/li>\n<\/ul>\n\n\n\n<p>\u00centocmirea corect\u0103 a dosarului de salariat te poate scuti de situa\u021bii nepl\u0103cute, dar mai ales de amenzile deloc mici ale ITM. Asigur\u0103-te c\u0103 ai toate documentele necesare at\u00e2t \u00een varianta fizic\u0103 (pe h\u00e2rtie), c\u00e2t \u0219i electronic (stocate \u00eentr-un cloud).<\/p>\n\n\n\n<div class=\"schema-faq wp-block-yoast-faq-block\"><div class=\"schema-faq-section\" id=\"faq-question-1772106296100\"><strong class=\"schema-faq-question\">Dac\u0103 dosarul de personal e electronic, trebuie ca toate documentele s\u0103 fie semnate electronic?<\/strong> <p class=\"schema-faq-answer\">Nu neap\u0103rat. Dosarul se \u021bine \u00een format electronic \u0219i trebuie s\u0103-l po\u021bi pune la dispozi\u021bia ITM la cerere, dar po\u021bi avea documente scanate (semnate olograf) + documente semnate electronic. Dac\u0103 alegi semn\u0103tur\u0103 electronic\u0103 pentru rela\u021bia de munc\u0103, intr\u0103 \u00een joc \u0219i regulile de arhivare a documentelor electronice.<\/p> <\/div> <div class=\"schema-faq-section\" id=\"faq-question-1772106723543\"><strong class=\"schema-faq-question\">Pontajul\/condica de prezen\u021b\u0103 trebuie pus(\u0103) \u00een dosarul personal al fiec\u0103rui angajat?<\/strong> <p class=\"schema-faq-answer\">HG 295\/2025 d\u0103 un minim pentru dosar \u0219i pontajul nu apare ca element obligatoriu \u00een lista minim\u0103, \u00eens\u0103 \u00een controale ITM se cere foarte des eviden\u021ba timpului de munc\u0103 (pontaje\/condici). Cel mai bine p\u0103streaz\u0103 pontajele \u00eentr-un folder HR separat, dar u\u0219or de prezentat la control.<\/p> <\/div> <div class=\"schema-faq-section\" id=\"faq-question-1772106811441\"><strong class=\"schema-faq-question\">ITM accept\u0103 documentele doar \u00een format electronic la control? Pot s\u0103 le trimit \u00eenainte pe email?<\/strong> <p class=\"schema-faq-answer\">Da. Codul muncii oblig\u0103 organele de control s\u0103 accepte documentele \u00een format electronic (semnate electronic) f\u0103r\u0103 s\u0103 cear\u0103 \u0219i varianta pe h\u00e2rtie \u0219i
